{"id":5514,"date":"2018-12-15T14:44:08","date_gmt":"2018-12-15T14:44:08","guid":{"rendered":"http:\/\/adalauk.org\/?p=5514"},"modified":"2018-12-25T20:00:29","modified_gmt":"2018-12-25T20:00:29","slug":"european-commission-morocco-intend-sell-off-western-saharas-resources-gain","status":"publish","type":"post","link":"https:\/\/adalauk.org\/?p=5514","title":{"rendered":"The European Commission and Morocco intend to sell off Western Sahara\u2019s resources for their own gain."},"content":{"rendered":"<p><span class=\"s3\"><span class=\"bumpedFont15\">Brussels \u2013 The President of British NGO <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">Adala<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> UK, Sidi Fadel, concluded a visit to Belgium last week where he met with MEPs from across the political spectrum. During these meetings he discussed the <a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2018-02\/cp180021en.pdf\">ruling<\/a> of the ECJ that invalidated the trade agreement between Morocco and the EU, stating it could not apply to <a href=\"https:\/\/www.bbc.co.uk\/news\/world-africa-14115273\">Western<\/a> <a href=\"https:\/\/www.bbc.co.uk\/news\/world-africa-14115273\">Sahara<\/a>, given that the territory is \u2018distinct and separate\u2019 from Morocco. <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">Adala<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> made it clear that any decision which attempts to include the waters of Western Sahara in any future agreement should be negotiated with the <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">Polisario<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> Front. This is the only <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">means by which<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> to uphold the decision of the court, which stated that consultation with the Saharawi people was necessary.<\/span><\/span><\/p>\n<blockquote><p><span class=\"s4\"><span class=\"bumpedFont15\">Mr Fadel also noted that<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> \u201cSaharawi resources, which rightly belong to the Saharawi people, cannot be controlled by any foreign country; not Morocco nor the European Union<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, because Western Sahara\u2019s land does not fall under either of their sovereignty\u201d. Mr Fadel highlighted that instead of exploiting <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">these natural resources, they should be preserved, arguing that from the start, the European Commission and Morocco have ignored the court ruling and international law with the intention of selling off Western Sahara\u2019s resources. This has involved a series of policies of illegal means and an agreement that was made without consulting MEPs. <\/span><\/span><\/p><\/blockquote>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">The <\/span><\/span><a href=\"http:\/\/www.adalauk.org\"><span class=\"s4\"><span class=\"bumpedFont15\">Adala<\/span><\/span><\/a><span class=\"s4\"><span class=\"bumpedFont15\"> UK President, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">reminded those with whom he met, that Western Sahara has been occupied by Morocco since 1975 and according to international law is a country awaiting decolonisation. Western Sahara is one of the territories looked after by the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Fourth (Special Political Decolonization) Committee of the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">UN <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">General Assembly<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">. According to the Fourth Committee, the current situation in Western Sahara stems from the war that took place between Morocco (the occupying power) and the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Polisario<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Front (representative of the Saharawi people) between 1975 and 1991. In 1991, armed conflict ceased under the proviso that the international community would organise a referendum of self-determination to enable the Saharawi people to decide their future. Taking all of this into account, Mr Fadel argues that the EU\u2019s role must uphold international legitimacy and not further complicate the situation by violating international law and plundering natural resources of a people who are not able to enjoy their self-determination, nor their independence.<\/span><\/span><\/p>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Regarding the matter of <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">bringing <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">benefit to the Saharawi people, which is noted in the proposed new agreement, Mr Fadel notes that the decision of the ECJ is clear and stated that the Saharawi people must be consulted<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, and the Saharawi people are<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> represented by the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Polisario<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Front. Mr Fadel underlines that the only legal requisite to apply the agreement to Western Sahara is to get the agreement of their representative, the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Polisario<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Front.<\/span><\/span><\/p>\n<p><span class=\"s3\"><span class=\"bumpedFont15\">Mr Fadel added that the repeated rise in forced displacement of the <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">Saharawis<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> continues as a result of policies of impoverishment, marginalisation and repression. \u201cFor 43 years of Moroccan invasion into the region of Western Sahara, Moroccan forces have made more than 250,000 Saharawi citizens abandon their homes and move into neighbouring countries, making it the biggest forced displacement in North Africa since 1975. The contin<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">ued<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> policy of repression and impoverishment of the Saharawi people on their land<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> which boasts <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">so <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">many riches<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">,<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> has forced a large number of <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">Saharawis<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\"> to migrate to other parts of the world. A lack of support <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">for international law<\/span><\/span> <span class=\"s3\"><span class=\"bumpedFont15\">from the European Union<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">, <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">alongside the inability of the international community to fulfil the Saharawi people\u2019s right to self-determination<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">, a<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">s established by numerous UN resolutions, is another cause of impoverishment and migration for the <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">Saharawis<\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">.\u201d<\/span><\/span><\/p>\n<blockquote><p><span class=\"s4\"><span class=\"bumpedFont15\">\u201cMEPs must understand that if they approve the new illegal agreement that the Commission is bringing to vote and include the waters of Western Sahara in a fishing agreement between Morocco and the EU, the one and only legitimate representative of the Saharawi people, the <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Polisario<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> Front, will return immediately to the ECJ. This will mean that the agreement will be null and void and the cycle of disputes will simply begin again. Now is the time to respect the ruling of the ECJ instead of continuing with further disputes.\u201d<\/span><\/span><\/p><\/blockquote>\n<p><span class=\"s4\"><span class=\"bumpedFont15\">Mr Fadel pointed out that <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">\u201c<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">despite the fact that the ruling of the court was clear that any agreement with Morocco that included Western Sahara could not be legitimate, we must not forget that the EU has stated in previous agreements with Morocco that Western Sa<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">hara has always been a subject of discussion between the EU and Morocco. Human rights and democracy by virtue of the EU-Morocco Association <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Agreeement<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, particularly Article 2 establishes that \u2018respect of democratic principles and fundamental human rights enshrined in the Declaration of Human Rights is a source of inspiration for national and foreign policies for the Union and Morocco and they will be an essential element of this Agreement\u2019. Yet our organisation, <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Adala<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\"> UK, document<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">s<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Morocco\u2019s <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">systematic human rights abuses. This includes continued repression of peaceful protests for the right to self-determination and <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">a <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">systematic policy of discrimination against <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">Saharawis<\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">, repression of the right to freedom of opinion <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">and <\/span><\/span><span class=\"s4\"><span class=\"bumpedFont15\">expression, persecution of activists and human rights defenders and a large number of cases of arbitrary detention which are confirmed by our organisation and by the UN Human Rights Council\u2019s Working Group on Arbitrary Detention. <\/span><\/span><\/p>\n<p><span class=\"s3\"><span class=\"bumpedFont15\">Sidi Fadel <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">has asked that the European Union and the international community take<\/span><\/span> <span class=\"s3\"><span class=\"bumpedFont15\">the necessary measures to force Morocco and the European Commission to fulfil their obligations under <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">European<\/span><\/span><a name=\"_GoBack\"><\/a><span class=\"s3\"><span class=\"bumpedFont15\"> and international law, including the <\/span><\/span><span class=\"s3\"><span class=\"bumpedFont15\">EU\u2019s human rights principles and international humanitarian law.
